Terms & Conditions

Booking and Methods of Payment – We accept electronic payments via Venmo and Stripe.  Payments via Venmo and Stripe are subject to their card processing fees.  Which will be retained by Venmo or Stripe once the transaction is complete.  A non-refundable date reservation retainer of 50% of the total must be made at the time of booking for all cake orders of $350 or more.  For cake orders of $349 or less, payment in full is required upon booking, and is non-refundable and non-transferable.  The 50% date reservation retainer to secure your order on our calendar must be sent to us within five (5) business days of receiving your custom cake quote from us.  If the retainer has not been received after five (5) business days, your date may become unavailable.

Balance of Payment — The balance payment is due two weeks (14 days) prior to the event date for custom cakes.  It is the client’s responsibility to provide the final payment by this deadline, and we do not send a reminder.  Midtown Bakery reserves the right to cancel the order if the balance has not been received on time.  No payments made to us will be refunded or transferred, and we will be under no further obligation. 

Delivery Restrictions -- We do not offer delivery for any order less than $225.  Midtown Bakery cannot a guarantee that we will have the capacity to deliver your cake as our deliveries are scheduled on a first-come, first-served basis.  In these instances, your cake may need to be picked up from Midtown Bakery instead.  We will discuss the options with you based on our availability.

Order Changes— Once the balance payment has been submitted, the order specifications are deemed to be finalized and no further alterations may be made.  This includes design modifications and changes in the number of cake servings provided.  It is the client’s responsibility to submit any changes needed no later than 14 days prior to the event date.  Beyond that date, no further changes may be made to the order and absolutely no refunds will be issued.

Cancellation Policy – The retainer payment (to secure your cake order on our calendar) is non-refundable and non-transferable.  If you wish to cancel your order with us outright, we must receive notification of your intent to cancel your order in writing.  If we receive an order cancellation request less than two weeks (14 days) prior to your event date, the balance payment is still due, and is non-refundable and non-transferable.

Fresh Flowers – If you wish to have fresh flowers arranged on your cake, you acknowledge that fresh flowers are not food products, and may be toxic or contain pesticide/herbicide residues, dirt, insects, and/or other contaminants. 

Sole Provider – For reputation-management and food-safety reasons, all cakes for your event must be supplied by Midtown Bakery.  If any cake is provided by an individual or company other than Midtown Bakery (including groom’s and sheet cakes), we reserve the right to leave your venue without setting up your cake, and all payments made to us will be forfeited.  We will dispose of your undelivered cake at our discretion.

Our Obligation – We take our obligation to provide your cake very seriously.  However, should an unforeseeable event occur that prevents us from fulfilling our obligation and forces us to cancel our agreement with you, we will refund your payment in full.  In addition, if at all possible, we will work with you to find another qualified local baker to assist you with your cake and will communicate your specifications to the new baker/designer.

Liability for Mistakes – While we make every effort to provide exactly the flavors, fillings, decorations, sizes, shapes and colors you have requested, the creation of a custom cake is an art and may be subject to slight variations and/or errors by the creator(s).   Decorative finishes are done by hand and are subject to the creative interpretation of the cake artist.  You may provide us with a photograph for inspiration; however, we make no claims for exact duplication of the work represented in such images.  Due to the handcrafted nature of our products, we do not provide refunds or exchanges for custom orders.  Refunds requested due to decorating style, writing, color shade, or general design will not be honored after your cake has been picked up (by you or your representative) or after we have delivered your cake and departed from the venue.

Client assumes full responsibility for making sure all nonedible cake décor, are removed from the cake before it is cut and served.  While most décor is edible, it is not always intended for consumption.  For example, if your custom cake includes sugar flowers, they are made from edible materials, but are not intended for consumption as wires are added for strength and flexibility to achieve a more natural look.  DO NOT EAT DÉCOR.

Allergens – Midtown Bakery’s products may contain or come in contact with milk, wheat, nuts, cocoa or other allergens.  While every precaution will be taken in the cases of known allergies, it remains the full responsibility of Client to inform guests of possible allergens.  Midtown Bakery is not responsible for any allergic reactions.

Limitation of Liability – Midtown Bakery will endeavor to perform its services in a professional manner and provide the best customer experience possible.  In the event that our products or services do not meet our high standards, we may — at our discretion — offer store credit towards a future purchase.  Midtown Bakery’s total liability is hereby limited to amounts paid to Midtown Bakery for its goods and services.  Midtown Bakery will not be liable for any special, incidental, punitive, or consequential damages, whether foreseen or unforeseen, regardless of whether liability is based on breach of contract, breach of express or implied warranty, negligence, strict liability, tort, or otherwise.

Post-Setup Precautions – Once the cake assembly/setup is complete at your event venue, Midtown Bakery is not responsible for any damage to the cake other than damage that occurs as a result of improper construction/production.  If your venue is outdoors, it is your responsibility to take the necessary precautions (shading, level ground, insect netting, wind protection, temperature control, etc.) to ensure that the cake remains intact beyond initial setup.

Photographs of Your Cake – We reserve the right to take and use our own photos of your cake(s) to use for marketing and promotional purposes without compensation to you.  We may also request photographs from your photographer for the same purpose, although we would credit the photographer in our marketing (if the photographer agrees thereto).

In submitting payment to Midtown Bakery in any amount, the client agrees to the aforementioned Terms & Conditions.
